Shared Pharmacy Services - UPDATE

The New York Board of Regents approved an emergency amendment on May 19, 2026 to the state’s Shared Pharmacy Services which is set to go into effect May 22, 2026. Initially any pharmacist involved in processing prescriptions for New York patients through shared services arrangements needed an individual New York pharmacist license. The emergency amendment states that the shared pharmacy services rules apply specifically when an instate New York pharmacy participates in the arrangement. The amendment also states that nonresident pharmacies shipping directly to New York patients without partnering with a New York pharmacy are not subject to the regulations. Pharmacists working for nonresident pharmacies may fulfill licensure requirements through active licensure and good standing in their home state instead of obtaining full New York pharmacist licensure. The proposed rule will be presented to the Board of Regents for permanent adoption at the September 2026 Regents meeting.
