Education Law prohibits a pharmacy from offering prescription drugs for retail sale in a non-registered area. Automated Dispensing Machines (ADM) that store and provide prescription drugs for sale outside of registered pharmacy areas are in violation of state law. Responsibility for compliance is placed upon the ownership of the pharmacy and the Supervising Pharmacist.
On a separate note, Hospital Pharmacies may stock prescription drugs on nursing unit floors as long as the floor stock medication is reviewed and recommendations are made concerning drugs to be stocked on the floors.
